Email Legal Notice

Last updated: 5 November 2026

WebAcumen Software Development and Hosting ("WebAcumen", "we", "us"). Our company details are in our Terms of Service.

1. Application

1.1 This notice applies to every email, and every attachment, sent from a WebAcumen email address or system. 1.2 Each such email refers to this notice. In terms of section 11(3) of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), this notice, our Terms of Service and our Privacy Policy are incorporated into, and form part of, that email.

2. Confidentiality

2.1 Emails and attachments may contain confidential, proprietary or privileged information and are intended solely for the named recipient(s). 2.2 If you are not the intended recipient, you must notify the sender immediately, delete the email and all copies, and not use, disclose, copy or distribute any part of it. Receipt of an email in error does not waive any confidentiality or privilege attaching to it.

3. No binding agreement

3.1 A proposal, estimate or quote sent by email is an invitation to do business, not a binding offer, and may be withdrawn or amended until accepted in accordance with its terms. 3.2 No agreement is concluded, varied or terminated by email unless expressly confirmed in a written agreement, or in the formal acceptance of a proposal, estimate or quote, by a person authorised to bind WebAcumen. 3.3 A name, signature block or automated signature in an email is not an electronic signature for the purpose of concluding or varying any agreement, unless the email expressly states otherwise. 3.4 Every engagement is subject to our Terms of Service and to any signed agreement between the parties. 3.5 Personal views expressed by individual senders are their own and do not necessarily represent those of WebAcumen.

4. Security and integrity

4.1 Email is not an inherently secure medium. Messages may be intercepted, altered, corrupted, delayed, misdirected or infected during transmission. 4.2 We take reasonable precautions to protect our email systems, but we cannot guarantee the security, integrity, timely delivery or freedom from malicious software of any email or attachment. Recipients are responsible for scanning all emails and attachments before opening them. 4.3 To the extent permitted by law, WebAcumen accepts no liability for loss or damage arising from the circumstances described in 4.1 and 4.2. 4.4 We will never change our banking details by email. Before making any payment, verify any apparent change by telephone on a number you already hold for us.

5. AI-assisted communication

5.1 WebAcumen uses artificial intelligence tools to assist with certain correspondence, including drafting, summarising and responding to emails. 5.2 Some emails may be prepared and sent by an AI assistant without prior review by a member of our team. Every such email is clearly identified as AI-generated, and all AI-assisted correspondence is overseen by our team. An AI-generated email does not conclude, vary or terminate any agreement, or bind WebAcumen to any commitment, unless confirmed in accordance with clause 3.2. 5.3 Should you prefer to communicate exclusively with a member of our team, say so in your reply and a team member will take over the correspondence.

6. Personal information and monitoring

6.1 We process personal information contained in emails in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and our Privacy Policy. 6.2 Emails sent to or from our systems may be monitored, recorded and retained for security, compliance, record-keeping and quality purposes, as permitted by law.

7. Statutory rights

Nothing in this notice limits any right a person has under applicable law that cannot lawfully be excluded, including under the Consumer Protection Act 68 of 2008, or any obligation WebAcumen has under a signed agreement.

8. Governing law

This notice and every email to which it applies are governed by the laws of the Republic of South Africa.
