Acceptable Use Policy

1. Purpose & Scope

This Acceptable Use Policy ("AUP") sets out what may not be done using WebAcumen's services and infrastructure. It applies to every service we provide — web hosting, email, domain names, and applications we host or manage — and to everyone who uses them, including the users and customers of clients who resell or provide our services to others. This AUP forms part of our Terms of Service. Breaching it is a breach of your agreement with WebAcumen. We may update this policy from time to time; the current version is always available on this page.

2. Unlawful Use

Our services may not be used for any purpose that is unlawful in South Africa or in the jurisdiction where the user is located. This includes, without limitation: • Storing, publishing, or distributing material that depicts or promotes the sexual exploitation or abuse of children. We apply zero tolerance: such content is removed and reported to law enforcement immediately. • Fraud, scams, pyramid or Ponzi schemes, and deceptive commercial practices. • Publishing or distributing content that infringes copyright, trademarks, or other intellectual property rights. • Content that is defamatory, incites violence, or constitutes hate speech under South African law. • Sale or distribution of illegal goods or services.

3. Email & Spam

3.1 Unsolicited bulk email (spam) may not be sent from, or advertise services hosted on, our infrastructure — regardless of where the mail itself is sent from. 3.2 Marketing email sent through our services must comply with POPIA and the Electronic Communications and Transactions Act: recipients must have opted in or be existing customers, every message must identify the sender, and every message must include a working unsubscribe mechanism. 3.3 Mailing lists must be permission-based. Purchased, harvested, or scraped address lists may not be used. 3.4 Accounts that generate spam complaints, send to high proportions of invalid addresses, or damage the sending reputation of our mail infrastructure may be rate-limited or suspended.

4. Security & Network Abuse

The following are prohibited on or from our infrastructure: • Phishing — hosting pages or sending messages designed to trick people into revealing credentials, banking details, or personal information. • Distributing malware, ransomware, viruses, or spyware, or operating botnet command-and-control infrastructure. • DNS abuse in any form, including pharming and deliberately misleading DNS configurations. • Attempting to access accounts, systems, or data without authorisation, including credential-stuffing and brute-force attacks. • Port scanning, vulnerability scanning, or penetration testing of any system without the documented consent of its owner. • Participating in denial-of-service attacks, or knowingly operating services that facilitate them. • Interfering with, or attempting to circumvent, the security or integrity of any WebAcumen system.

5. Resource Abuse

Shared infrastructure works because every account uses resources fairly. The following are not permitted without a written agreement that provides for them: • Cryptocurrency mining. • Sustained workloads that materially degrade performance for other clients on the same infrastructure. • Operating open proxies, open mail relays, or public file-sharing hubs. • Using a hosting account primarily as a backup target, media vault, or file distribution point unrelated to a hosted website or application. Where an account's resource usage affects other clients, we will contact the client to discuss options — including moving to dedicated infrastructure — before taking action, except where immediate action is needed to protect the platform.

6. Enforcement

6.1 We investigate suspected breaches of this AUP and may, depending on severity: issue a warning, remove or disable specific content, suspend the affected service, or terminate the account. 6.2 Serious abuse — unlawful content, phishing, malware, botnet activity, or spam campaigns — may result in immediate suspension without prior notice. 6.3 Where the law requires it, or where content or conduct is criminal, we cooperate with law enforcement and the relevant authorities, and we process takedown notices issued under the ISPA code of conduct and applicable legislation. 6.4 The client remains responsible for fees during suspension, and for the reasonable costs of investigating a confirmed breach.

7. Reporting Abuse

To report abuse involving a WebAcumen-hosted service or domain, email support@webacumen.co.za with the subject "Abuse Report" and include: • The domain name or URL involved. • A description of the abuse, with supporting evidence (screenshots, email headers, log extracts). • Relevant IP addresses and timestamps where available. • Your contact details, so we can follow up. We acknowledge abuse reports and review them promptly — typically within one business day. Reports from law enforcement are prioritised. We may request further information where the evidence provided is insufficient to act on, and we retain abuse-handling records for compliance purposes.
